Terms and Conditions

Taxes

7% state sales tax will be collected on all shipments to a New Jersey address, unless a valid resale certificate is on file.  As of October 1, 2006, shipping charges to NJ customers are also subject to NJ sales tax.  All items picked up in person at Zeckhausen Racing are subject to NJ sales tax, regardless of the residence of the customer.  See: http://www.state.nj.us/treasury/taxation/vendors.htm for more details.

Freight

Unless otherwise specified or agreed to, all goods will be shipped by UPS surface freight, pre-paid and added to the invoice. All domestic freight charges are invoiced at actual cost and no handling charges are billed for standard freight. The customer may specify alternate shipping (e.g., Next Day Air, 2nd Day Air, 3-Day Select), at time of order.

International orders may require additional handling charges for customs paperwork and other overhead costs.  Credit cards for international orders will be accepted at Zeckhausen Racing's discretion for small items.  More expensive items may be paid for with a bank wire transfer, prior to shipment of goods.  Because our bank currently charges a $25 fee for receipt of wire transfers, this amount will be added to the invoice.  Payment may also be made by Western Union.  See: http://www.westernunion.com/info/osIndex.asp for instructions.

Customers are responsible for any duty or tariffs imposed by your local government agency.  Carriers, such as UPS, may charge the customer for border brokerage fees.  For this reason, we try to ship international orders via USPS, since they do not charge these fees.  For heavier items, such as brake rotors, USPS becomes impractical because weight limitations.  We will let you know your shipping options and make recommendations based on our experience and your deadline.

Insurance

Domestic shipments worth more than $100 are insured. UPS insurance rates are currently $0.35 / $100 declared value.  UPS may change these rates without prior notice and these rates will be passed along to the customer.

Freight Damage

Any and all damage claims must be made with the responsible carrier. Claims must be made by you the customer, as Zeckhausen Racing can not initiate claims on your behalf.

Wheel to Caliper Clearance of Big Brake Kits

In many cases big brake kits will not fit under stock wheels. Most 17" wheels will clear the outer diameter of calipers on brake kits with 328 and 332mm rotors, while an 18" wheel is typically required for 355mm kits. However, some 17" wheels will clear 355mm kits.

The more critical clearance is between the back of the wheel spokes to the outer face of the caliper. Do not assume an 18, 19 or even 20+ inch wheel will clear the outer face of the caliper.  Templates and measurements are available to help customers determine wheel fitment, and we can tell you about wheel combinations we've successfully used.  Some wheel manufacturers, such as HRE, can build a wheel for you that takes into account the dimensions of your big brake kit.  BBS wheels has an online application guide at the following link: bbs-usa.com (click on "Application Guide" in the upper left corner of the BBS web page.)

Final fitment of big brakes, however, is the responsibility of the customer.

Wheel Spacers

Wheel spacers can provide extra clearance to the outer face of the caliper. This will also space out the entire wheel, widening the track width of the vehicle. Basic suspension settings will generally not be adversely affected by a slight widening (5-15mm per side) of the track. Fender clearances should be checked on lowered cars, and longer lug studs or wheel bolts will be required.

It is the responsibility of the customer to insure wheel spacers are properly specified and installed.

Brake Vibration

The most common cause of brake vibration is thickness variations on the rotor. As delivered, kits from StopTech have typical rotor thickness variation within 0.0003". Actual rotor thickness variation will never change, though pad material may be deposited unevenly on one or more spots of the rotor face. Under extreme conditions, any rotor will suffer uneven pad deposition due to improper bed-in or exceeding the pad's Maximum Operating Temperature (MOT). This deposited material may induce a vibration, and if severe enough, can only be cured by replacing the rotor. Not following proper break-in procedures for the rotor and pads, or using street pads on the track are the most common causes of brake vibration. Leaving a foot on the brake pedal when the brakes are hot may also cause pad deposits on the rotor.  For best results, follow these guidelines when installing new pads, rotors, or big brake kits: Proper Bedding Procedure

Zeckhausen Racing is not liable for vibrations caused by extreme usage or improper break-in procedures.

Brake Noise

Certain brake pad compounds make more noise than others. Proper anti-squeal shim plates between the caliper pistons and backing plate of the pad may help reduce the problem. Anti-squeal lubricants are also available to reduce or eliminate the noise. The reality is, some performance pads are more prone to brake squeal than others.  And full race pads, when used on the street, may squeal like an old school bus.

The customer is responsible for any squeal related problems due to pad selection.

Returns

To return goods for refund or credit, please contact Zeckhausen Racing to obtain an RMA (Returned Materials Authorization) number. Any item(s) received without an RMA, may be refused.

All returned goods must be in their original packaging. All items must be properly wrapped and packed for shipment to avoid damage.  With the exception of returns that are the result of our error, shipping costs for returned items are the responsibility of the buyer.  Returned items must be received by Zeckhausen Racing within 30 days of your original receipt of the order.

All goods must be returned freight pre-paid and insured. To obtain full credit, returned goods and original packaging must be unused and in new condition.  For example, product boxes covered with greasy handprints are not returnable.

All returned items (other than returns caused by our error) are subject to a re-stocking fee of 20% or a minimum of $25.

Disclaimer of Warranty / Limitation of Liability

By purchasing the brake kit and/or components contained herein and opening the accompanying box or packaging, the purchaser(s), his/her/their buyer(s) and/or the ultimate user(s) expressly (1) acknowledge that he/she/they have read and understood all terms set forth herein; (2) understand and agree that the brake kit and/or components, whether acquired new or used, whether complete or incomplete, whether of merchantable or non-merchantable quality, whether saleable or non-saleable, is taken, purchased, selected and/or acquired "AS IS" and "WITH ALL FAULTS"; (3) acknowledge that the brake kit and/or components contained herein are intended only for off-street use, regardless of whether said brake kit and/or components are approved by a state or the United States Department of Transportation; and (4) understand and agree that he/she/they bear all risks, including but not limited to the risk as to the quality and performance of said brake kit and/or components, the risk of any and all liability arising from the use or misuse and/or correct or incorrect installation of said brake kit and/or components, and the risk of bearing the costs of repair or replacement of the subject brake kit and/or components, whether in defective or non defective condition.

ZECKHAUSEN RACING MAKES NO EXPRESS OR IMPLIED WARRANTIES, WHETHER ORAL OR WRITTEN, WHETHER TRUE OR UNTRUE AND REGARDLESS OF SOURCE, TO ANY PURCHASER(S), HIS/HER/THEIR BUYER(S) AND/OR ULTIMATE USER(S) OF ITS BRAKE KITS AND/OR COMPONENTS. ANY IMPLIED WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS HEREBY EXPRESSLY AND EFFECTIVELY DISCLAIMED AND SUCH DISCLAIMER IS ALSO HEREBY ACKNOWLEDGED BY THE PURCHASER(S), HIS/HER/THEIR BUYER(S) AND/OR ULTIMATE USER(S) RATHER, THE PURCHASER(S), HIS/HER/THEIR BUYER(S) AND/OR ULTIMATE USER(S) EXPRESSLY AND IMPLIEDLY AFFIRM THAT HE/SHE/THEY ARE RELYING UPON HIS/HER/THEIR OWN SKILL AND JUDGMENT IN SELECTING AND PURCHASING THE KIT AND/OR COMPONENTS CONTAINED HEREIN AS SUITABLE FOR HIS/HER/THEIR INTENDED USE.

Automobile racing and performance driving, whether sanctioned or not, whether on or off the road, are dangerous. Products used in such environments/applications are subject to stresses and conditions outside of normal use, wear and tear. All equipment sold or provided by Zeckhausen Racing LLC is sold WITHOUT WARRANTY, EXPRESSED OR IMPLIED. No warranty or representation is made to the product’s ability to protect the user from injury or death. The user assumes all risk. Zeckhausen Racing LLC is NOT responsible for any damage, consequential or otherwise, for equipment failure or malperformance after installation. Under no circumstances is Zeckhausen Racing liable for labor charges or loss of use.

The purchaser(s), his/her/their buyer(s) and/or the ultimate user(s) understand and agree that no officer, director, employee, agent, salesman, representative, distributor, or other affiliate of Zeckhausen Racing has any authority to make any statement or representation contrary to the terms set forth hereinabove. Any such statement or representation is hereby effectively disavowed.

Changes to Terms and Conditions

Zeckhausen Racing reserves the right to change these Terms and Conditions at any time without prior notice, and purchaser's continued purchase of parts constitutes acceptance of those changes.
